Omni Persistence Helps Client Recover over $20,000 from IRS
A business owner hired Omni to help with a levy on his personal bank account for Trust Fund taxes. Nearly $44,000 of the $70,000 account was captured by the levy. The client was upset because the tax debt relief agency with which he had previously been working kept telling him to ignore the levy notices.
Even though he explained that the IRS had incorrectly miscalculated his debt for one of the quarters by approximately $20,000, the Revenue Officer refused to listen. The Revenue Officer even assessed civil penalties for that quarter, since the W-2s, W-3s and 941s did not match up.
The client was able to prove that he had sent the Revenue Officer the correct return a few months prior, and that the officer had never sent it in for adjustments. After hearing this, the Revenue Officer finally understood the complaint, and reassured the client that the period would be adjusted. After about 6 months of not hearing anything, Omni contacted the Revenue Officer who was on the case to ask about the status of the account being adjusted. The officer informed Omni that the IRS had made the adjustments and applied the money to the client’s business account.
Because the business account was separate from the personal account, the money should have been refunded to the client personally. Omni did a breakdown of the business transcripts and personal ones, and found that the money had not been credited anywhere.
Omni then filed an Application with Taxpayer Advocate in February of 2008. Three months later, the Taxpayer Advocate reported that the client would be receiving a total refund of $20,113.18.
